Artificial intelligence is advancing faster than the policies meant to govern it, leaving businesses in regulated industries to navigate a fragmented and rapidly shifting landscape. As global approaches diverge, from prescriptive regulation to innovation-first restraint, leaders must understand not just where AI rules are headed, but how accountability, risk, and governance will be enforced in practice.

Recently, there has been a significant amount of conflicting news regarding the role and importance of AI regulation, as government and industry entities globally weigh in. Before diving into the policy, it helps us to understand this dynamic environment by framing the broad application space in which AI is rapidly moving.
The Organization for Economic Co-operation and Development (OECD) defines an AI system as:
“A machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. Different AI systems vary in their levels of autonomy and adaptiveness after deployment.”
AI is a general-purpose technology that can be molded and applied to nearly every product or process, regardless of industry. It is also only as effective as the quality of the data used to train a model, the design, development, and deployment practices, and resilience to corruption and attack once in operation. AI is widely regarded as a revolutionary technology with global impact not unlike the discovery of metallurgy or splitting the atom.
The question of regulating AI should not be seen as “if”, but as “how.” Historically, any new technology has progressed through a natural trial-and-error cycle before capabilities, limitations, and risks are confidently understood. In some instances, the maturity process has led to the development of new technologies or procedures that offer additional benefits beyond the original intent.
Regulations play a vital role in maximizing benefits and limiting risks associated with groundbreaking technologies. It is also important to understand that regulation often plays catch-up to expectations formed from tensions arising between existing legal frameworks, ethical principles, and social and business conventions.
Countries and industry associations are taking fragmented approaches to a continuously evolving field. Some are attempting to solidify a leadership position by publishing comprehensive frameworks, while others are maintaining a “wait-and-see” stance.
On August 1, 2024, the European Union's AI Act came into force, which is regarded by some as the gold standard for comprehensive AI regulation.The AI Act’s goal is to foster the responsible design, development, and deployment of AI that is safe, robust, and respects fundamental human rights. It predominantly focuses on AI systems posing an unacceptable risk, such as government-run social scoring, or a high-risk, such as employment application screening tools, which are subject to specific legal conditions. This is particularly relevant in regulated sectors such as financial services and healthcare, where automated decisions directly impact access to credit, care, and coverage.
In addition, the EU published the Ethics Guidelines for Trustworthy AI, a document created by the independent body, the High-Level Expert Group (HLEG). This document stipulates that trustworthy AI is lawful, ethical, and robust. The text provides a detailed breakdown that emphasizes important considerations and offers recommendations for creating ethical and robust systems.
In stark contrast, the recent U.S.Executive Order on artificial intelligence signals a clear federal priority: prevent state-level AI regulation from slowing innovation by establishing a single, minimally burdensome national policy framework. Rather than introducing substantive AI safeguards, the EO focuses on deterring and penalizing state laws deemed inconsistent with federal objectives, including through litigation and conditional funding.
This approach centralizes authority while leaving fundamental questions unresolved, most notably how AI risks are defined, assessed, and governed in the absence of clear federal standards, and whether innovation speed is being treated as a substitute for risk management. The policy reflects a calculated tradeoff between competitiveness and caution, but also exposes uncertainty about the federal government’s depth of understanding of AI’s underlying and emergent risks.
If speed is prioritized over structure, who ultimately carries the liability when AI systems fail - developers, deployers, or regulated institutions? As with past general-purpose technologies, U.S. AI policy will continue to evolve as legal challenges, market failures, and real-world impacts force greater action.
In China, the waters are murkier where the government sees AI as a strategic driver of global competition and national security. While that view is consistent with the EU and the US, it has exercised strict control over AI technology and implemented surveillance and data collection methods that highlight alternative views of ethics and human rights values.
With an industry lens, independent associations have long been the origin of standards, frameworks, accreditation, and measures that the governing bodies use to form policy and enforcement practices. These non-governmental organizations (NGOs) typically consist of diverse experts who reach a consensus-based resolution. Some organizations are specific to certain industries, such as the Coalition for Health AI (CHAI) and the Financial Industry Regulatory Authority (FINRA). Others, like the International Organization for Standardization (ISO) and the Institute of Electrical and Electronics Engineers (IEEE), drive operational standards that impact multiple industries. Direct involvement with or tracking these organizations as an early policy indicator may be a vital AI-readiness practice for those at the forefront of their field.
Various entities face a significant challenge due to the rapid pace of innovation in AI technologies. Even the most advanced technology companies struggle to keep up with these developments. Meanwhile, law makers appear to be lagging, seemingly hindered by the slow process of formulating a coherent set of AI ethics and principles to guide policy creation. This dynamic is intensified when considering a globally diverse set of cultures and societies that view these principles differently. This complex problem may only be addressed through healthy collaboration across researchers, industry leaders, and policymakers.
As AI continues to evolve and become more autonomous, many are raising concerns about fairness, explainability, and accountability. For organizations subject to supervisory review, model risk management, and patient or consumer protection laws, these concerns are not theoretical. The predictions, recommendations, and decisions made by these systems can be susceptible to biases that stem from incomplete or manipulated data sets. The potential for discrimination or anti-competitive behavior has prompted many organizations to prioritize ethical assessments as a fundamental aspect of AI governance.
Leading AI researchers, such as Yoshua Bengio and Geoffrey Hinton, along with organizations like the Responsible AI Institute and Partnership on AI, are actively engaging in discussions with society, industry, and governments to foster a healthy and responsible global AI community.
Looking forward, we may be best served to look in the rearview mirror. As with every major technological shift, AI regulation will evolve incrementally rather than arrive fully formed. Policymakers will continue extending existing legal and regulatory frameworks into the context of AI, often retrofitting rules that were never designed for adaptive, autonomous systems.
The legal system will play an increasingly influential role. As AI-driven decisions are challenged, judicial precedent will begin to define acceptable risk, accountability, and liability. These rulings will shape policy as much as legislation, particularly in areas such as data sovereignty, privacy protection, consumer harm, and professional responsibility.
AI systems do not respect national borders, yet regulatory authority remains largely national. This tension will continue to drive efforts toward international standards and coordination. While full alignment is unlikely, shared principles and baseline expectations may emerge through multilateral agreements and industry-led initiatives, similar in spirit to efforts like the Paris Climate Agreement.
Ultimately, the success or failure of AI adoption will hinge less on technical capability and more on governance maturity. Organizations will need to balance innovation with accountability, aligning AI use with evolving social norms, ethical expectations, and regulatory scrutiny while still delivering sustainable business value.
As AI becomes embedded in critical workflows, leaders will no longer be able to defer hard decisions. Tradeoffs between speed, control, transparency, and risk tolerance will need to be explicitly defined and defended. Doing so will require greater AI literacy, open dialogue with stakeholders, and the ability to demonstrate responsible use in practice and in principle.
